New 24 Hour Mandatory Delay Law In Florida

The State of Florida now requires all persons seeking abortions to delay their care for 24 hours and make two trips to a clinic. This means that a person must make two separate appointments, at least 24 hours apart, to receive an abortion. Delaying access to abortions is medically unnecessary and we understand that this delay will cause hardships for the people seeking care such as missed work, lost wages, increased travel costs, and additional childcare considerations. Gainesville Woman Care Llc V State Of Florida

On June 11, 2015, Florida abortion providers filed suit in state court to challenge a medically unnecessary law that would force virtually all people seeking abortions, unlike any other patients in Florida, to delay the care they need against their will and regardless of their personal circumstances. Since its enactment in 2015, the restriction has largely been blocked, but on March 23, 2022, a Florida state trial court indicated that it intended to rule for the State and dismiss the challenge, and, on April 8, 2022, the court issued an order upholding the law. The medically unnecessary and harmful law took effect upon entry of final judgment on April 25, 2022.

Passed in June 2015, the law being challenged, HB633, prevents a person seeking an abortion in Florida from obtaining their medications or procedure for at least 24 hours after meeting with a doctorand in practice, often far longer. The law forces patients to make an additional, medically unnecessary trip to the clinic, which is extremely burdensome for many patients and impossible for some. Rather than improve the counseling a person receives, HB633 harms Floridians by forcing them to remain pregnant against their wishes for days or weeks longerregardless of the health risksand prevents some patients from obtaining a desired abortion at all.

Oral argument in the Florida Supreme Court is scheduled for November 1, 2016, at 9:00 am.

Clinic Is Limited To 15 Weeks

  • Failure to document job descriptions for LPN, surgery assistant, and sonogram tech, hand holders and other staff
  • Unlicensed, unqualified, untrained staff providing patient care.
  • Failure to ensure patients, family, or representatives are informed of their right to report complaints, neglect, and fraud.
  • Facility failed to display clinic license so that patients could see it. Clinic was licensed to perform abortions up to 12 weeks, but was regularly performing abortions exceeding this by not documenting gestational age. Patients did not know the clinic wasnt licensed for these procedures because the license wasnt posted in public.
  • Facility failed to comply with building standards. Facility did not have hands free hand washing sinks near exam/procedure areas.
  • Expired Medications and supplies. Facility was using out of date meds and out dated supplies used during abortion procedures including vacuum tubes and supplies, surgical blades, test strips, and needles.
  • Failure to purchase and maintain required equipment. Facility did not have a portable suction machine for use in emergency.
  • Failure to accurately document patient records. Failure to ensure first trimester abortions were not performed in excess of 14 weeks. Clinic failed to properly document last known menstrual period for patients resulting in second trimester abortions being performed as if they were first trimester.

Bread And Roses Disputes Allegations

In its claims alleging that Bread and Roses illegally provided abortion care during the second trimester, AHCA cited supporting documentation for five abortions provided at the clinic that did not state the dates of the womens last normal menstrual periods. AHCA contended Bread and Roses should be fined $500 for each case, for a total of $2,500.

Kristin Davy, owner and director of Bread and Roses, disputed the allegations. She said ultrasound information included in the patient files showed the time of gestation, which Davy said was standard practice.

Davy added that Bread and Roses had been using the same practice to submit reports to AHCA for a decade, throughout which time the clinic has operated under the same license restrictions on abortion care.

You will fill out paperwork, receive labwork , have an ultrasound, and then meet with a Patient Advocate and the Physician. The Physician will inform you about the procedure and discuss the risks, your ultrasound and lab results, anesthesia options, aftercare, and birth control. They will also address any and all questions or concerns that you may have. We will send you home with your return appointment date and time. The first appointment generally takes about 2 hours.

  • Dont eat any food 2 hours before your appointment.

  • If you plan to use any sedation, you must have a driver with you

After you check in, you will meet with a Patient Advocate and then the Physician.     Bread And Roses Clinic Applies For Buffer Zone To Protect Against Protestors

    The Bread and Roses Womens Health Clinic in Gainesville is looking to expand privacy protection for people who use its clinic by requesting a buffer zone to keep protestors at bay.

    The ordinance, if passed, would keep protestors 35 feet from the clinics property. It would also give people who are within 100 feet of entering the clinic an eight-foot personal bubble, according to the clinics

    Kristin Davy, director of the clinic, said protesting has become an issue because the protestors are so close to the entrance that it makes it difficult for anyone to enter or exit the clinic without being obstructed.

    The protestors need to back off a little bit, Davy said. Theyre invading privacy, theyre disrupting the patients, and it is not reasonable.

    Davy said she realized there was a problem when a group of protesters who were granted a 40-day, 40-night permit that allowed them to protest near the clinic failed to follow the permits guidelines.

    There were rules to be followed, Davy said. Those rules were not followed, and the permit was not revoked.

    Gainesville Police Department spokesman, Ben Tobias, said the department reviewed the complaints when they were made but found no evidence to support the need for a buffer zone.

    He said there have only been three incidents since 2005 that have taken place near any of the clinics in Gainesville. Two of those were property crimes.

    We frankly dont see the need for it, Tobias said.

    Florida passed a law in 2015 forcing a woman to wait a minimum of 24 hours and make at least one additional trip to her health care provider before receiving an abortion. The law fails to include any exceptions for a woman whose pregnancy threatens her health or a meaningful exception for survivors of rape, incest, or intimate partner violence. The Florida Legislature has never before imposed a mandatory delay or additional-trip requirement on any other medical procedure.

    Waiting periods can create a variety of burdens on a woman who needs safe and legal abortion carefrom stigmatizing women and abortion providers, to requiring additional trips to the clinic, which means additional travel time, transportation costs, child care, and time off work. Women of color, low-income women, rural women, and women in abusive relationships already face challenges when they seek health care services, and waiting periods only increase these barriers. Additionally, mandatory waiting periods can lead a woman to delay the abortion to later in pregnancy, which can increase the cost of the procedure and pose additional risks.
